b. Limited License: Upon enrollment in a Course, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Course content for your personal, non-commercial educational purposes only.

 

c. Prohibitions: You agree not to:

  • Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content or Courses.

  • Sell, resell, rent, lease, lend, or exploit for any commercial purposes any part of the Service or Course content.

  • Share your account login details or Course access with anyone else.

  • Remove or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Service.

6. Course Enrollment, Payment, and Refunds

 

a. Enrollment: When you enroll in a Course, you are purchasing a license to access that Course through the Service.

b. Pricing and Payment: All prices for Courses are listed in Indian Rupees (INR) unless otherwise specified and are subject to change without prior notice. Payment processing is handled securely by third-party payment gateways Razorpay. We do not store your sensitive financial information on our servers. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

7. User Conduct and Prohibitions

  • Any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm The Code Mark or users of the Service or expose them to liability.

 

 

8. Disclaimers

 

a. No Guarantees of Financial or Specific Outcomes (Applicable Courses): For Courses specifically related to financial strategies, income generation, career outcomes, or other directly measurable professional results, The Code Mark provides educational content, strategies, and tools. We do not guarantee any specific financial outcomes, earnings, career advancements, or other precise results from using these particular Courses or Services. Your individual results will depend on various factors, including your effort, prior knowledge, market conditions, personal aptitude, and external circumstances beyond our control. Any testimonials or examples of success are illustrative only and are not a guarantee of similar results.

 

b. "As Is" Basis: The Service and all Courses are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Our total liability to you for any damages, losses, and causes of action shall not exceed the amount paid by you, if any, for accessing the specific Course or Service giving rise to the liability.

You agree to defend, indemnify, and hold harmless The Code Mark, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Contributions, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

 

 

11. Termination

 

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us.

Our Service may contain links to third-party websites or services that are not owned or controlled by The Code Mark. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that The Code Mark shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

 

 

13. Governing Law and Jurisdiction

 

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai.

 

 

14. Severability

 

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

 

 

15. Entire Agreement

 

These Terms, together with our Privacy Policy and any other legal notices published by The Code Mark on the Service, shall constitute the entire agreement between you and The Code Mark concerning the Service.
